    Examples of disputes:
    Dispute over people's behaviour may involve conflict between neighbours over anti-social behaviour (loud parties or verbal abuse)
    Business disputes can involve different interpretation of the terms of a contract, or questions over whether a contract has been breached, and what remedies/damages are appropriate.
    Planning disputes include situations where, for example, a property owner plans to construct a new building, or improve an existing building. (ie planning permissions)
    Environmental disputes include disputes over resources and questions over who has the right to exploit those resources, and at what cost to the environment.

ADR: Alternative Dispute Resolution:

  • negotiation: participation is voluntary and there is no third party who facilitates the resolution process or imposes a resolution
  • arbitration:participation is typically voluntary, and there is a third party who, as a private judge, imposes a resolution. Arbitrations often occur because parties to contracts agree that any future dispute concerning the agreement will be resolved by arbitration.
  • mediation:there is a third party, a mediator, who facilitates the resolution process (and may even suggest a resolution, typically known as a "mediator's proposal"), but does not impose a resolution on the parties

Gentile Prof.ssa le lascio un piccolo intervento sui termini affrontati oggi in classe.Ho fatto una piccola ricerca approfondita sui vari vocaboli trattati.


-SETTLEMENT:the action or process of setting; an official agreement intended to resolve a dispute or conflict; (settlement law = an arrangement whereby property passes to a person or succession of people as dictated by the settlor).


-HEARING: a legal proceeding before a court or other decision making body or officer,such as a government agency.A Hearing is generally distinguished from a trial in that it is usually shorter and often less formal.In the course of litigation, hearings are conducted as oral arguments in support of motions, whether to resolve the case without further trial on a motion to dismiss or for summary judgment, or to decide discrete issues of law, such as the admissibility of evidence, that will determine how the trial proceeds. Limited evidence and testimony may also be presented in hearings to supplement the legal arguments.


-PLEADING:In law as practiced in countries that follow the English models, a Pleading is a formal written statement filed with a court by parties in a civil action, other than a motion. By stating what claims and defenses are at issue, pleadings establish the issues to be decided by the court.Pleading in the courts of the individual states is covered by the rules of civil procedure either promulgated by the respective state Supreme Courts, or by statute by the respective legislatures.

-OUT OF COURT SETTLEMENT:resolution of a dispute prior to the rendering of a final decision by the trial court.It's a legal arrangement initiated and completed outside of the formal judicial process; without the involvement of courts and judges, but usually with the active involvement of the attorneys representing opposing parties. Also called negotiated settlement.

-BINDING DECISION:is when you will have to follow the decision made by a 3rd party or a court(a judge).
Arbitration is an example of binding decision.


-LEGAL FEES:The type of fee arrangement that you make with your lawyer will have a significant impact on how much you will pay for the services.Legal fees depend on several factors, including the amount of time spent on your problem; the lawyer's ability, experience, and reputation; the novelty and difficulty of the case; the results obtained; and costs involved.
