Berlusconi's era

British lawyer David Mills has said he would be prepared to testify in Italy against former PM Silvio Berlusconi under certain circumstances.

He was giving evidence at Westminster Magistrates court via video link in a corruption trial being heard in Milan.

Mr Berlusconi is involved in four trials. One relates to allegations of corruption involving his former tax lawyer, David Mills.

Mr Mills was convicted of perjury in 2009 but the verdict was later quashed.

He avoided serving a jail term because the case against him expired under Italy's statute of limitations.

The case against the former prime minister had earlier been suspended under a temporary immunity law. Mr Berlusconi is alleged to have paid Mr Mills $600,000 (£385,000) to lie under oath in two corruption trials in the 1990s.

In court in London on Monday, Mr Mills said he "would be willing to go to Italy but I am not sure what evidence I would be expected to give. I would ask my counsel to clarify what those circumstances might be."

Mr Berlusconi said he had difficulty staying awake during the trial

Acting for Mr Mills, James Lewis QC asked for the hearing to be adjourned until the public prosecutor in Milan explained what testimony he would be asked to provide.

"In our respectful submission this shouldn't be an inquisition," he said.
'No judicial outcome'
Mr Berlusconi attended proceedings in Milan. He resigned as prime minister earlier this month as Italy's borrowing costs soared.

Speaking to reporters afterwards, he complained that he had struggled to stay awake during the session and shrugged off the importance of the trial.

"This is a trial that will have no judicial outcome since it will expire in February," he said. "All the people who were in the hall, some paid by Italian taxpayers, some by me, are wasting their time."

Mr Berlusconi denies wrongdoing and alleges the Milan prosecutors are pursuing a political vendetta against him.

Mr Mills is the estranged husband of former UK cabinet minister Tessa Jowell.

Mr Berlusconi faces two other corruption trials and is also accused in another case of paying an underage prostitute and of abuse of power.

In all cases he says he is innocent.

In January, Italy's Constitutional Court swept away part of a law passed in 2010 which granted 18 months of immunity to the prime minister and some of his senior ministers.

Leasehold, pur traducendosi con proprietà in affitto, si riferisce alla locazione del suolo. Il termine fa riferimento ad un rapporto giuridico in base al quale un soggetto detto lessor(locatore) conferisce al lessee (locatario) un diritto esclusivo di proprietà sull’immobile per un periodo di tempo determinato, di solito per una consideration detta ground rent . Deve essere sottolineato che il lease si differenzia profondamente dalla locazione così come intesa nei sistemi civilistici, soprattutto per il fatto che il titolare del lease è titolare di un diritto di natura reale sull’immobile, dove invece il locatario dei sistemi di civil law può vantare soltanto un diritto di credito nei confronti del locatore. Quando si acquista una proprietà con leasehold bisogna prestare attenzione alle covenants, ossia le obbligazioni alle quali il lessee è tenuto ad osservare, la cui presenza rappresenta una delle particolarità più difficile da accettare per chi è abituato al sistema civilistico.

The statute of frauds del 1677 fu la prima legge nel sistema inglese a prevedere la forma scritta ad probationem, ossia la possibilità di far valere in giudizio un contratto che è e rimane valido di per sé. Successivamente il Law of Property Act 1925 ritenne obbligatoria la forma scritta ad probationem solo per i contratti aventi per oggetto la proprietà o altri diritti reali su beni terrieri e il Law Reform (Enforcement of Contracts) Act 1954 stabilì che detta forma fosse da ritenersi necessaria per i contratti di garanzia.[read more..]
Traditionally, the statute of frauds requires a writing signed by the party against whom enforcement is sought in the following circumstances:
• Contracts in consideration of marriage.
• Contracts which cannot be performed within one year.
• Contracts for the transfer of an interest in land. Contracts by the executor of a will to pay a debt of the estate with their own money.
• Contracts for the sale of goods above a certain value.
• Contracts in which one party becomes a surety (garanzia acts as guarantor) for another party's debt or other obligation.

Law students often remember these circumstances by the mnemonic "MYLEGS" (marriage, year, land, executor, goods, surety). It is important to note that in the United States, each State; in Canada, each province; and in Australia each State has its own variation on the statute of frauds, which may differ significantly from the traditional list.

Hello, I'm Robin, welcome to TransLegal's lesson of the week. And today I'm going to talk about the differences between the terms robbery, burglary, theft and larceny. All of these are takings, but they are distinguished by the means, the methods and the victims of these takings.

We will start with theft and larceny. These two words are synonymous and they refer to the simple taking of anything of value with an intent to permanently deprive the owner, that is an intent to keep whatever you've stolen. Common examples of theft and larceny are, for instance, shoplifting, taking something from a store. And there are several degrees of theft and larceny. Unlike in other crimes when we talk about first degree, second degree, third degree to explain the seriousness of the crime, usually when we talk about theft and larceny we talk about grand larceny or petty theft and the difference between a grand and a petty crime when it comes to theft and larceny is usually about five hundred American dollars depending on the jurisdiction. So, for instance, if you steal a few paperback books from a bookstore you will probably be charged with petty larceny. However, if you steal a car from an open public parking lot you will probably be charged with grand larceny, otherwise known as grand theft auto.

Now if we add another element to the taking crime, if we add the element of an unlawful entry, then you get a burglary, and unlawful entry is sometimes called breaking and entering or housebreaking, but it is also an element of a burglary and when you burgle, as you would do in British English, or burglarize a premises, it means you have entered that premises to take something or to otherwise commit another crime.

Now the last one on our list, robbery, which is often deemed to be the most serious, is a foreceable stealing from a person. This time we're adding a person. In the previous examples, we stole a car from an open parking lot, no people there. We stole books from a store, there might have been people around, but we didn't do the taking from a person. Now we are actually adding real or threatened physical force.

So, for instance, a mugging, when you hold somebody up on the street, in public, that's an example of a robbery. A purse snatching when you steal somebody's purse from their body, that's a robbery. A car-jacking when you steal a car with somebody in it, that's another example of a robbery. Or one of the most popular robberies these days, stealing a mobile phone from somebody's hand or pocket, that's also a robbery. Now the actual threat or force does not have to be real. All it needs to be is threatened or assumed by the victim. So, for instance, when I was robbed some years ago, the robber came over to me and he said 'give me your wallet and don't turn around because my friend is standing in back of you with a gun pointed at your head'. So I gave him my wallet and ran away. When I called the police and explained it they said, oh well when we catch that guy, we're going to charge him with robbery. It doesn't matter if there ever was another person there who was pointing a gun or not. What matters is that you felt threatened and you perceived that there was going to be force. So, anyway, all you have to do is be afraid that someone will use force against you to have it be a robbery.

Now just so that you know, the names of people that commit these crimes. If you commit a theft and larceny, you are a thief. If you commit a burglary, you're a burglar. If you commit a robbery, you're a robber.

I termini "freehold" e “leasehold” sono entrambi termini di matrice feudale.
Il primo possiamo renderlo con “proprietà fondiaria assoluta/libera” Chi acquista una “freehold” proprietà diventa “freeholder” e acquisisce il massimo dei poteri possibili su quell’immobile e senza alcun limite di tempo;

Rientrano in questo istituto:
• Fee simple = diritto assoluto sulla proprietà
• fee tail = Il beneficiario ha un diritto limitato in quanto non può vendere il bene ma solo tramandarlo ai suoi eredi; la proprietà ha un vincolo inalienabile
• life estate = il bene è di proprietà del beneficiario solo per la durata della sua vita

Leasehold, pur traducendosi con proprietà in affitto, si riferisce alla locazione del suolo. Il termine fa riferimento ad un rapporto giuridico in base al quale un soggetto detto lessor(locatore) conferisce al lessee(locatario) un diritto esclusivo di proprietà sull’immobile per un periodo di tempo determinato, di solito per una consideration detta ground rent . Deve essere sottolineato che il lease si differenzia profondamente dalla locazione così come intesa nei sistemi civilistici, soprattutto per il fatto che il titolare del lease è titolare di un diritto di natura reale sull’immobile, dove invece il locatario dei sistemi di civil law può vantare soltanto un diritto di credito nei confronti del locatore. Quando si acquista una proprietà con leasehold bisogna prestare attenzione alle covenants, ossia le obbligazioni alle quali il lessee è tenuto ad osservare, la cui presenza rappresenta una delle particolarità più difficile da accettare per chi è abituato al sistema civilistico.

The statute of frauds del 1677 fu la prima legge nel sistema inglese a prevedere la forma scritta ad probationem, ossia la possibilità di far valere in giudizio un contratto che è e rimane valido di per sé. Successivamente il Law of Property Act 1925 ritenne obbligatoria la forma scritta ad probationem solo per i contratti aventi per oggetto la proprietà o altri diritti reali su beni terrieri e il Law Reform (Enforcement of Contracts) Act 1954 stabilì che detta forma fosse da ritenersi necessaria per i contratti di garanzia.[read more..]

Traditionally, the statute of frauds requires a writing signed by the party against whom enforcement is sought in the following circumstances:
• Contracts in consideration of marriage.
• Contracts which cannot be performed within one year.
• Contracts for the transfer of an interest in land. Contracts by the executor of a will to pay a debt of the estate with their own money.
• Contracts for the sale of goods above a certain value.
• Contracts in which one party becomes a surety (garanzia acts as guarantor) for another party's debt or other obligation.

Law students often remember these circumstances by the mnemonic "MYLEGS" (marriage, year, land, executor, goods, surety). It is important to note that in the United States, each State; in Canada, each province; and in Australia each State has its own variation on the statute of frauds, which may differ significantly from the traditional list.

An Italian court has convicted three Google executives in a trial over a video showing an autistic teenager being bullied.
The Google employees were accused of breaking Italian law by allowing the video to be posted online.
Judge Oscar Magi absolved the three of defamation but convicted them of privacy violations.
The UK's former Information Commissioner Richard Thomas said the case gave privacy laws a "bad name".
The three employees, Peter Fleischer, David Drummond and George De Los Reyes, received suspended six-month sentences, while a fourth defendant, product manager Arvind Desikan, was acquitted.
David Drummond, chief legal officer at Google and one of those convicted, said he was "outraged" by the decision.
'Ridiculous case'
"I intend to vigorously appeal this dangerous ruling. It sets a chilling precedent," he said.
"If individuals like myself and my Google colleagues who had nothing to do with the harassing incident, its filming or its uploading onto Google Video can be held criminally liable solely by virtue of our position at Google, every employee of any internet hosting service faces similar liability," he added.
Peter Fleischer, privacy counsel at Google, questioned how many internet platforms would be able to continue if the decision held.
"I realise I am just a pawn in a large battle of forces, but I remain confident that today's ruling will be over-turned on appeal," he said.
Richard Thomas, the UK's former information commissioner and consultant to privacy law firm Hunton & Williams, said the case was "ridiculous".
"It is like prosecuting the post office for hate mail that is sent in the post," he told BBC News.
"I can't imagine anything similar happening in this country. The case wasn't brought by the Italian equivalent of the information commissioner but by criminal prosecutors and we don't know their motives.
"I find it worrying that the chief privacy officer who had nothing to do with the video has been found guilty. It is unrealistic to expect firms to monitor everything that goes online."
Seeking consent
The verdict is likely to have ramifications for content providers around the globe.
Google said at the trial that pre-screening all YouTube content was impossible.
The video at the centre of the case was posted on Google Video in 2006 shortly before the firm acquired YouTube.
Prosecutors argued that Google broke Italian privacy law by not seeking the consent of all the parties involved before allowing it to go online.
Google's lawyers said that the video was removed as soon as it was brought to its attention and that the firm also provided information on who posted it.
As a result four students were expelled from their school in Turin, northern Italy.

In riferimento a un accordo tra la scuola Kingsmore di Bournemouth UK e la II facoltà di Giurisprudenza di Taranto su iniziativa della prof.ssa M. Lombardi si è convenuta la seguente opportunità:

- di offrire agli studenti più meritevoli (quelli individuati nei risultati della prova di esame) 3 borse di studio per ogni appello (da dicembre a marzo 2010) del valore di £ 275 per realizzare un corso di inglese in Inghilterra.

Costo del programma £ 750 sterline include:

Appello del 21 dicembre - Risultati Esami

Commento del docente:

I risultati dell’appello del 21 dicembre sono una chiara lettura del peso attribuito dagli studenti all’esame di lingua inglese. L’introduzione del test di entrata voleva essere un modo per responsabilizzare lo studente a misurare le proprie capacità e competenze. Con questo screening iniziale, lo studente aveva l’opportunità di valutare se necessitava la frequenza del corso o era nelle condizioni di presentarsi direttamente all’esame. Al contrario è stato visto come una forzatura il cui risultato comunicato, in moltissimi casi, non è da ritenersi attendibile, visto il dato riportato e quello invece raccolto in sede di esame. Il test di entrata presenta delle difficoltà superiori a quelle incontrate durante l’esame e deve essere svolto nelle stesse condizioni di esame, vale a dire senza dizionario e nei tempi indicati.

Confortante è il dato che il 90% dei frequentanti abbia superato l’esame! e per alcuni, pur avendo conseguito un risultato al test di entrata inferiore a 40/100!!! Well done!

Leasehold, pur traducendosi con proprietà in affitto, si riferisce alla locazione del suolo. Il termine fa riferimento ad un rapporto giuridico in base al quale un soggetto detto lessor conferisce al lessee un diritto esclusivo di proprietà sull’immobile per un periodo di tempo determinato, di solito per una consideration detta ground rent . Deve essere sottolineato che il lease si differenzia profondamente dalla locazione così come intesa nei sistemi civilistici, soprattutto per il fatto che il titolare del lease è titolare di un diritto di natura reale sull’immobile, dove invece il locatario dei sistemi di civil law può vantare soltanto un diritto di credito nei confronti del locatore. Quando si acquista una proprietà con leasehold bisogna prestare attenzione alle covenants, ossia le obbligazioni alle quali il lessee è tenuto ad osservare, la cui presenza rappresenta una delle particolarità più difficile da accettare per chi è abituato al sistema civilistico.

Statute of frauds
The statute of frauds refers to the requirement that certain kinds of contracts be made in writing and signed.Traditionally, the statute of frauds requires a writing signed by the party against whom enforcement is sought in the following circumstances:

Contracts in consideration of marriage.
Contracts which cannot be performed within one year.
Contracts for the transfer of an interest in land.Contracts by the executor of a will to pay a debt of the estate with their own money.
Contracts for the sale of goods above a certain value.
Contracts in which one party becomes a surety (acts as guarantor) for another party's debt or other obligation.

Law students often remember these circumstances by the mnemonic "MYLEGS" (marriage, year, land, executor, goods, surety). It is important to note that in the United States, each State; in Canada, each province; and in Australia each State has its own variation on the statute of frauds, which may differ significantly from the traditional list. The term statute of frauds comes from an English statutory law (29 Car. II c. 3) passed in 1677 and more properly called the Statute of Frauds and Perjuries. [1] Many common law jurisdictions have such a statute (i.e., statutory law) or provision in a statute, while a number of civil law jurisdictions have similar requirements in their civil codes

Dry work is concerned with day-to-day events such as resolving charter party disputes (dispute per contratti di noleggio) and handling cargo claims (reclami riguardanti il trasporto merci).
Wet work is connected with more complicated events such as groundings (when the ship runs aground=arenaggio di una nave), salvage (salvataggio dei beni) and torts.

Language

A charter party is a contract between a ship's owners and a cargo company, where a ship is hired for a voyage or for a period of time
A cargo claim is a claim for compensation for goods lost or damaged by a shipping company
A bill of lading (polizza di carico) is a receipt issued by a carrier to the shipper, containing all the details of the goods. The ship sends the bill of lading to the consignee, who exchanges it back for the goods when they arrive.
